Privatizing Sovereignty? The Cross-border Legal Problems and Solutions between China and Taiwan
The People's Republic of China (China) and the Republic of China (Taiwan) have not resolved their sovereignty dispute, but their economic and social ties have grown amidst such political tension. Although, for the purpose of not retreating from their standpoints on their sovereignty dispute, the two governments refuse to negotiate directly with each other, they employ government-organized non-governmental organizations (GONGOs) to negotiate with each other on the issues arising from their economic and social ties. What is the interaction between the public/private distinction of law and the sovereignty dispute? How have them been understood and how can them be understood in the future?
