Rethinking Market Structures: Policy Questions and Regulatory Answers in Music Licensing and Distribution.
As the 20th century unfolded, the ways in which individuals created and experienced music changed dramatically. Expanding intellectual property rights allowed for the emergence of organizations that grouped composers, authors and publishers, and empowered them in substantive ways. New professions emerged and old trades were allowed to sustain new and enhanced livelihoods. Sometime along a century of evolution, however, a particular breed of these organizations, called Performing Rights Organizations (PROs) lost its way. PROs began to overpower their constituents and as market creatures, learned the ways of market power, expansion and abuse. The ways in which these organizations grew and maintained their positions of dominance against composers and music users, as well as the ways in which new markets are to be shaped for this industry, are the seminal concerns of my work. For this, I rely on antitrust analysis and economic theory as they intersect with Intellectual Property.
