Dissertation

Scientific Imagination and Modern Legal Thinking

My goal is to investigate how scientific ideas and philosophical ideas about science have influenced modern legal thinking. Of particular interest is the influence these ideas have exerted on the major shifts in the answers offered to questions about the nature of law and about legal reasoning over the last two centuries.

To reflect on this topic, I focus on two main frontlines. First, tracing how legal theorists have made selective use and adaptation of suggestive analogies and illustrative metaphors from scientific ideas while advancing their positions. My second frontline will inquire how philosophical thinking about science has also provided an enduring set of models for modern social science, with a notable impact on legal theorizing. Here, I am particularly interested in investigating how legal theories are influenced by ideas from philosophy of science.
