Introduction (1)

The purpose of this chapter is to expose students to the concepts of relevancy, probativeness, prejudice, conditional relevancy, and limited relevancy and to the uses and abuses of probability/statistical proof. The pertinent federal rules are 401-403 and 104(b). Rules 406-411 are discussed in Chapter II, which forms a logical continuation of Chapter I. Rules 404 405, 412 -415 (character) are treated separately in Chap III ter because of the special problems encountered in teaching the use of character evidence as proof on substantive issues. Evidence of character relevant only to witness credibility is included with other material on impeachment in Chapter IV.
